  • 1. Users

    By accessing the website http://www.klic-klic.com (“Site”) and its contents, you will be considered a “User” and we assume you have read and entirely agreed to the terms and conditions below. Please read these carefully. If you don't agree to these terms and conditions, please exit this site and do not access its contents or services.

    E-PROCESS reserves the right to change, modify, add or remove all, or sections of, these terms and conditions at any time, without notice. As a result, please ensure you read and agree to these terms and conditions each time you access the site and its contents.

  • 2. Use of the site
    • 2.1. General

      Users must be 18 or older and have legal capacity to agree to these terms and conditions. Users agree to use the site diligently and in compliance with law.

      Underage users are not allowed to enter this site or access its contents.       You agree and confirm: a) that you are authorised to enter into his agreement on your own behalf or, where applicable, on behalf of the legal entity you are representing; b) that the information you provide to E-PROCESS on registration is accurate and correct; c) that you will ensure that the information is always updated, accurate and correct; d) that you are not forging other user's identity, including E-PROCESS employees; and e) that by using the contents and services on this site you are not breaking any applicable law or regulation.

      You may need to create an account with a valid username and password to be able to access some of the functionalities or tools, available now on in the future, on www.klic-clic.com (“Account”). In particular, you will need a user account to access online the products available on www.klic-klic.com. You will be requested to choose a username and a password to access online services from www.klic-klic.com. E-PROCESS will also request some additional personal data. You are responsible for keeping your password safe and confidential. You agree not to use other user's username or password at any time, and to inform E-PROCESS immediately if you believe that someone else may be using your account or has accessed your password without permission. You are solely and entirely responsible for the use of your account.

      You will not use names, images or other content linked to your account that show nudity, violence, explicit sex; or content that is discriminatory, xenophobic or racist, harmful, threatening or defamatory; or content that threatens other user's privacy or is harmful for children or underage; or any other content that is generally not compliant with these terms and conditions, law or that is offensive or against public order and safety. If you break this obligation, E-PROCESS may revoke your user account.

    You agree to use this site and its contents and services in compliance with law and these terms and conditions, compensating E-PROCESS for any damage or loss caused by the inappropriate use of this site or its contents, or any use that is not in compliance with law or these terms and conditions.

    In particular, including but not limited to, you will not:

    Provide any content that undermines other persons’ dignity, whether it is discriminatory, xenophobic, racist, threatening, damaging, threatens other users’ privacy, is harmful for children and underage (including but not limited to images or representations of child abuse, child pornography or content involving minors in implicit or explicit sexual behaviour) or is against public order and safety.

    Use the site or its contents for unauthorised or fraudulent purposes.

    Access or attempt to access restricted areas or resources of this site if you fail to comply with our requirements to enter the site.

    Remove, alter, bypass or tamper with any firewall, protection or security systems that may have been installed on the site.

    Introduce or spread into the network viruses or any other systems that may cause damage to the software or hardware of the domain owner or any third parties.

    Attempt access, use or alter the details of the domain owner, providers or other users.

    E-PROCESS reserves the right, at any time, unilaterally and without notice, to modify the structure and design of the Site, alter, change or remove services, contents or general terms and conditions of the Site.

    E-PROCESS reserves the right to interrupt, suspend or terminate the Site or any of the other services within.

  • 5. Guarantee exclusion and responsibility

    E-PROCESS does not guarantee, or take responsibility for loss or damage of any nature that may be caused by:

    Lack of availability, maintenance or effective functioning of the site or its contents or services.

    Functionality, relevance or validity of the Site or its contents and services not living up to the needs, activity, desired outcome or expectations of the User.

    Presence of virus, malware or harmful software within the contents.

    Illicit, reckless or fraudulent use of the site or its contents by the user, or any other use that is not compliant with these terms and conditions, public order and generally accepted social customs.

    Failure of any third parties to comply with their obligations or commitments in relation to the services provided on the site.

      Total or partial reproduction of the site contents and services is strictly forbidden without the prior consent of E-PROCESS.

      The use of deep links, IMG or image links or site frames is strictly forbidden without the prior consent of E-PROCESS.

      No false, inaccurate or incorrect statements can be made about the site contents or services. Except for characters that are part of the hyperlink syntax, the website hosting the hyperlink shall not include branding, commercial names, signs, trademark, logos, claims or any other distinctive signs property of E-PROCESS without prior consent.

      The inclusion of hyperlinks on external websites does not imply any relationship between E-PROCESS and the owner of the website or portal hosting the link, or the knowledge or agreement by E-PROCESS to the services offered by the third party.

      E-PROCESS is not responsible for the contents or services available on any websites or portals hosting links to our site, or any information or statements on these.

    • 6.2. Links to third-party websites and contents

      The site offers links to external websites, which are managed and controlled by third parties.

      These links are only intended to help users find online information, contents and services, which shall by no means be considered as suggestions, recommendations or invitations to access external websites.

      E-PROCESS does not trade, manage, control or agree to the contents, services, information or statements available on external websites.

      E-PROCESS does not accept responsibility, not even indirect or subsidiary, for any loss or damage, of any nature, caused by access, maintenance, use, quality, legality, reliability or usefulness of the content, information, communications, opinions, statements, products and/or services available or offered on external websites not managed by E-PROCESS and which are accessible from the Site.

  • 7. Industrial and intellectual property

    Texts, images, logos, signs, sounds, photography, videos, source code and any other content on this site is the property of E-PROCESS, or E-PROCESS has the right to use and exploit these, and as such the above content is protected by relevant applicable industrial and intellectual legislation.

    It is strictly forbidden to transmit, communicate, share, distribute, reproduce, make available or store all or part of the site content for profit without prior consent of the content owners.

    For the purpose of preserving any industrial and intellectual property rights, if you suspect that any content on the site may be breaking your on any third party's property rights, you should notify us by email, indicating:

    • Personal details of the owner of the rights that may have been violated. If you are reporting a violation on behalf of a third party, you will need to indicate your representation role.
    • Which are the protected contents and where on the site they are hosted.
    • Proof of industrial or intellectual rights over the contents.

    Upon reception of notification, E-PROCESS may decide to remove user or third party content if it considers that this is violating a third party's intellectual property rights. E-PROCESS may equally refuse to remove user or third party content if it considers that there have been no infractions or if the notification is not complete or fails to identify the contents to be removed. E-PROCESS may, at its sole discretion, deny access to the website or its services to users that repeatedly violate third parties’ property rights. E-PROCESS may start legal action, or co-operate in legal action started by third parties, against other third parties that have violated property rights.

    Third parties providing content are solely and entirely responsible for ensuring the validity and legitimacy of the industrial and intellectual property over their own content.

    Access to the site does not grant the user any right or ownership of any industrial or intellectual property rights over the content, which is property of E-PROCESS.

  • 8. Privacy policy and personal data protection

    E-PROCESS may use web forms to gather personal data and user information for own use and storage. Details provided by the user will be included in a file owned by E-PROCESS, which has been duly registered with the Spanish Agency of Data Protection.

    For each form containing personal data, E-PROCESS will provide the user with detailed information on the use, processing and purpose of the data, a clear indication of compulsory/optional fields, the consequences of not providing the data and, in general, any other required statements, as per the information requirements by the Data Protection legislation, all of which will need express consent of the user. E-PROCESS shall not email commercial or advertising communications unless otherwise authorised by the client or user.

    In particular, E-PROCESS will request the following personal details to access Klic-Klic products and services online (all of which will be handled in accordance with our privacy policy): user name, email address, password, full name, gender, appearance, date of birth, city of residence, post code, country of residence, IP address, date and time of access and geo-localisation. Additionally, the user may provide additional personal data, such as pictures for profile/avatars, all of which will be handled by E-PROCESS in accordance with our privacy policy.

    E-PROCESS shall handle users' personal data in accordance with the data protection legislation in force. E-PROCESS has implemented technical security measures to ensure data protection, in accordance with data protection legislation, including Spanish Royal Decree 1720/2007.

    E-PROCESS informs that you can exercise your rights to access, rectify, cancel or oppose to data provided, by notifying us in written to the address provided at the top of these terms and conditions.

    E-PROCESS reserves the right to modify this privacy policy to adapt it to any legislation updates, decisions by any tribunal or the Spanish Data Protection Agency, industry practices or the company interests. Any change or update to the policy will be communicated beforehand, providing appropriate and sufficient notice to users.

    The user shall ensure details provided to E-PROCESS are kept up to date. The user is responsible for any loss or damage to E-PROCESS or any third party caused by inaccurate, incomplete, outdated, unauthentic or false data provided by the user.

  • 9. Use of cookies

    E-PROCESS, or a third party hired by E-PROCESS to provide metrics, may use cookies on the site. Cookies are files sent to the browser via a web server that record the user activities while surfing.

    Cookies associate anonymous users and their computers, and do not provide users’ personal details per se.

    The use of cookies allows the web server to recognise your browser, which helps to provide a better navigation experience. For example, cookies allow registered users to access exclusive or restricted areas, services, promotions or competitions with no need to log in each time.   • 10. Independence and integration of these general terms and conditions. Waivers. Prevalence of general terms and conditions.

    Shall any of the clauses within these terms and conditions be deemed illicit, invalid or irrelevant, this shall not invalidate or affect the remainder of the terms and conditions, provided that it does not essentially affect the user or E-PROCESS’s rights and obligations. ‘Essential’ means any situation that seriously affects or injuries the interest of the user or E-PROCESS. In this case, these terms and conditions shall be replaced or merged with other terms and conditions which are compliant with law and serve the same purpose as the terms and conditions being replaced.

    No waiver by E-PROCESS to any of these terms and conditions shall be valid or binding unless made in written. This waiver shall be valid for the specific purpose described in written only, and shall not impact E-PROCESS rights in any other area or at any other time.

    In case of discrepancy between these terms and conditions and the terms of any other communication between the E-PROCESS and the user, whether by email, fax, certified or postal mail, these terms and conditions shall prevail.

  • 11. Applicable legislation and jurisdiction

    Access and use of the site will be granted, managed and interpreted according to the Spanish law. Any controversy between E-PROCESS and the user shall be resolved by the courts of the user's city of residence. The site and its contents are offered within Spain only; therefore users living outside Spain irrevocably submit to the jurisdiction of the Courts of Barcelona, Spain.
